Terms of Service — Skalyr Forge

1. Acceptance of Terms

By accessing or using Skalyr Forge ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Skalyr Forge is an AI-powered ad creative platform that generates image ads, video ad blueprints, and advertising copy. The Service uses artificial intelligence to assist in the creation of marketing materials.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Infringe upon the intellectual property rights of others
Create misleading or deceptive advertising
Distribute malware or engage in phishing
Attempt to reverse-engineer, decompile, or disassemble any part of the Service
Use automated systems to access the Service in a manner that exceeds reasonable use

5. Intellectual Property

Content you create using Skalyr Forge belongs to you. You retain all rights to the ad creatives, copy, and other materials generated through your use of the Service. Skalyr retains ownership of the Service itself, including its underlying technology, templates, and AI models.

6. AI-Generated Content

Content generated by our AI tools is provided as-is. While we strive for quality, you are responsible for reviewing all AI-generated content before publishing or distributing it. Skalyr does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

7. Billing and Payments

Paid plans are billed on a recurring basis (monthly or annually). You may cancel your subscription at any time. Refunds are available within 14 days of purchase if you are unsatisfied with the Service. After 14 days, no refunds will be issued for the current billing period.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, Skalyr shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Service will immediately cease. You may export your data before account termination.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
